Gatherings with Purpose Contest
OFFICIAL RULES:
1. NO PURCHASE NECESSARY.
2. Entry: To enter the contest, complete an official online entry form (maximum one entry per person.) Entrants will be asked to provide first and last name, address, telephone number, date of birth (all entrants must be 18 years of age or older) and email address. Each entrant will be required to submit a story of a Gathering with Purpose in 400 words or less. The Gathering with Purpose must be legal and must provide assistance to a person, family or 501(c)(3) nonprofit organization in need. The entrant must reside in the United States, and individuals must be legal residents of the United States, 18 years or older at the time of entry. The contest begins Oct. 7, 2009, and ends Dec. 10, 2009. All online entries must be received by 11:59 p.m. CST on Nov. 12, 2009. Contestants agree to join an online reader's mailing list in order to receive winner information and monthly newsletters containing updates and announcements. All contestant information shall be used solely by Modern Woodmen of America. No contestant information will be sold, shared or given away. Contestants can unsubscribe anytime by emailing the webmaster@gatherings.info.
3. Eligibility: The contest is offered only in the United States to legal residents of the United States, who are 18 years or older at the time of entry. Employees or representatives of Modern Woodmen of America and their advertising agencies, including their immediate families, are not eligible to enter. Modern Woodmen of America will not be responsible for late, misdirected or lost entries or for any computer, online, telephone or technical malfunctions that may occur. The authorized account holder of the email address and the entrant must be the same person. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. All entries become the property of Modern Woodmen of America and will not be returned to entrant. Potential winner may be requested to provide proof that the potential winner is the authorized account holder of the email address associated with the winning entry.
4. Winner Selection: Five finalists will be selected by Modern Woodmen of America on or about Nov.18, 2009, based on submitted entries. The five finalists will be posted on www.gatherings.info on Nov.19, 2009, and the grand-prize winner will be determined through open online voting. Voters may only submit one vote per person, per day from Nov. 19, 2009, to Dec. 6, 2009. The grand-prize winner will be determined on or about Dec. 9, 2009. Winner will be notified within 10 days of selection. If winner is unreachable after 10 days, or if winner is unavailable for prize fulfillment, the second-highest vote getter will be declared the winner. Potential winner must execute and return an Affidavit of Eligibility form and provide a copy of the potential winner's driver's license or suitable photo ID and proof of Social Security number or taxpayer identification number within 10 days of notification via mail and/or facsimile. Noncompliance within this time period will result in disqualification, and an alternate winner will be selected. Decision of Modern Woodmen of America is final. Odds of winning depend on number of eligible entries received.
5. Grand Prize: One (1) $5,000 grand prize will be awarded in two separate $2,500 sums. The winning contest entrant will receive $2,500, and the person, family or organization supported through the winning entrant’s Gathering with Purpose story will receive the remaining $2,500. Four (4) runner-up prizes of $100 each will be awarded to the four nonwinning finalists, payable directly to the entrant. Disbursement of the grand prize will be made to the grand-prize winner and the Gathering with Purpose recipient upon receipt of an Affidavit of Eligibility form.
All other expenses are winner's responsibility. The prize is nontransferable. No substitutions will be made except at sole discretion of Modern Woodmen of America. The winner will be solely responsible for any and all local, state and federal taxes. This prize cannot be used in conjunction with any other promotion or offer.
6. Accepting Prizes: Finalists consent to potential use of name, photographs and/or voice for editorial, advertising, promotional and publicity purposes without further compensation except where prohibited by law. Finalists agree to release, discharge and hold harmless Modern Woodmen of America, all media outlets and all participating contest affiliates from all claims or damages arising out of this contest. Finalists are required to sign an Affidavit of Eligibility to receive prizes.
7. General Conditions: Contest entrants agree to abide by the terms of these Official Rules and by the decisions of Modern Woodmen of America, which are final on all matters pertaining to contests. This contest is governed by the laws of the United States and is void where restricted or prohibited by law. All federal, state and local laws and regulations apply. All taxes, fees and surcharges on prizes are the sole responsibility of the prize winner. Return of any prize/prize notification as undeliverable will result in disqualification and selection of an alternate winner.
8. Use of Name: Entrants further grant to Modern Woodmen of America the right to use their proper name, city and state online and in print or any other media, in connection with the contest. Acceptance of a prize constitutes permission for Modern Woodmen of America and its advertising and promotional agencies to use winners' names and likenesses for advertising and promotional purposes without additional compensation unless prohibited by law. By entering, participants release and hold harmless Modern Woodmen of America, its subsidiaries, affiliates, directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the contest or any prize won. Restrictions, conditions and limitations apply.
9. Conduct: By entering this contest, participants agree to be bound by these Official Rules. The Official Rules will be posted at www.gatherings.info and www.GatheringswithPurpose.com throughout the contest. Entrants further agree to be bound by the decisions of the judges that shall be final and binding in all respects. Modern Woodmen of America reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the contest or Web site; to be acting in violation of the Official Rules; to be acting in an unsportsman-like or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, MODERN WOODMEN OF AMERICA RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY LAW.
10. Limitations of Liability: Modern Woodmen of America is not responsible for any incorrect or inaccurate information, whether caused by Web site users or by any of the equipment or programming associated with or utilized in the contest or by any technical or human error which may occur in the processing of submission in the contest. Modern Woodmen of America assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Modern Woodmen of America is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Web site or combination thereof, including injury or damage to participants or to any person's computer related to or resulting from participating or downloading materials in this contest. If, for any reason, the contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Modern Woodmen of America, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this contest, Modern Woodmen of America reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest.
